If you violate any restrictions in these terms, you agree to indemnify Marjolein Empowers for any losses, costs or damages, including reasonable legal fees, incurred by Marjolein Empowers in relation to, or arising out of, such a breach.

2. ACCEPTANCE OF TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “your” or “user/clients”) and Marjolein Empowers (“Marjolein Empowers”, “we”, “us” or “our”), concerning your access to and use of the website. You agree that by accessing the Site, you have read, understood, and agree to be bound by the terms and conditions and Privacy Policy incorporated.

IF YOU DO NOT AGREE WITH ALL OF THESE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

In these Terms, “you” and “your” refer to the individual or entity that uses the Site, or Services. “We”, “us”, or “our” refer to Marjolein Empowers. 3. SERVICES PROVIDED

At Marjolein Empowers, we offer a range of coaching and self-development services to help individuals achieve their personal and professional goals. Our services include but are not limited to:

3.1. Coaching Services 1:1

Our 1:1 Coaching Services are designed to provide intesive, personalized, one-on-one, transformational coaching tailored to meet each client's specific needs.

The payment process for these services is conducted separately through direct communication with the client. Once the client commits to a program, a Stripe payment link will be sent via email, with the option to pay through the client's preferred secure payment methods.

Sessions are sold as packages that typically include 7 sessions per package. These sessions are conducted online, and clients have the flexibility to schedule their appointments using the online scheduling tool Calendly. The scheduling process allows clients to select times that best suit their availability, making the coaching experience flexible and convenient. Clients have the option to book additional sessions outside of the package, depending on their individual progress and needs. These additional sessions are priced separately and can be booked through the same scheduling system.

3.2. Group Coaching Programs

In addition to 1:1 coaching, we offer Group Coaching Programs which allow multiple clients to participate in a session together. These sessions foster a sense of community, offering participants the opportunity to learn from one another’s experiences while still receiving guidance from the coach. Group coaching sessions are typically held through the Heartbeat platform, an online coaching platform where clients can participate in live sessions and engage with other group members. To maintain a positive and respectful environment, all participants in group coaching programs are required to adhere to our Code of Conduct (referred to as the Code of Kindness). This document outlines the expectations for behavior during group sessions, ensuring that all participants feel supported and respected.

3.3. Workshops and Masterclasses

We also provide one-off free and paid workshops and masterclasses designed to address specific topics or areas of personal development. These workshops are available to a wider audience and are ideal for those who want to benefit from coaching but are not ready to commit to long-term programs. Workshop tickets are sold directly through our Website. These workshops are low-ticket, making them an affordable entry point for those interested in personal development.

4. CODE OF ETHICS

Marjolein Empowers, as a coaching service provider certified by the International Coaching Federation (ICF), adheres strictly to the ICF Code of Ethics, ensuring full compliance with the highest standards of ethical and professional conduct. All coaching services are provided with transparency, integrity, and accountability, emphasizing respect, confidentiality, and fairness in every interaction with clients, sponsors, colleagues, and the public. This unwavering commitment to professionalism fosters trust and safeguards the interests of all parties involved in the coaching process.

5. PAYMENT AND BILLING

All payments for our services, whether for 1:1 coaching sessions, group programs, or workshops, must be made in advance of the services being rendered. We offer secure payment processing through third-party providers, including Stripe and PayPal. Clients may choose their preferred payment method at checkout.

5.1. Currency and Pricing

All prices for services are listed in either Euros (EUR) or US Dollars (USD), depending on the nature of the service and the geographic location of the client. The pricing structure is clearly outlined on the Website and in communication with clients. Prices are subject to change, and any modifications will be reflected on the Website prior to booking.

5.2. Invoicing and Receipts

Upon payment, clients will receive an electronic receipt via email. This will serve as proof of payment and will outline the services purchased. Please retain your receipt for future reference.

5.3. Failed Payments

If a payment is unsuccessful due to insufficient funds, incorrect payment details, or other reasons, the client will be notified immediately and required to update their payment information. Services will not be rendered until full payment is made.

5.4. Taxes

All fees listed on the Website are exclusive of applicable taxes, unless otherwise stated. Clients may be responsible for any additional taxes based on their location, including VAT or sales tax.

6. CANCELLATIONS, RESCHEDULING, AND REFUNDS

We understand that circumstances can change, and we aim to offer flexibility where possible. However, specific policies apply regarding cancellations, rescheduling, and refunds.

6.1. Coaching Programs 1:1

Refunds for high-ticket programs are governed by an individual Coaching Agreement signed with each client. This agreements will outline the specific terms related to cancellations, refunds, and rescheduling.

6.2. Workshops and Masterclasses

For our low-ticket, paid workshops and masterclasses, no refunds are made available.

7. EXCLUSION OF LIABILITY FOR EXTERNAL LINKS

The Website may provide links to external Internet sites. Marjolein Empowers hereby declares explicitly that it has no influence on the layout or content of linked pages and dissociates itself expressly from all contents of all linked pages of third parties. Marjolein Empowers shall not be liable for the use or content of Internet sites that link to this site or which are linked from it. Our privacy and cookie notice do not apply to any collection and processing of your personal data on or through such external sites.

8. INTELLECTUAL PROPERTY

All content provided on our Website, including but not limited to text, graphics, logos, images, videos, and course materials, is the intellectual property of Marjolein Empowers unless otherwise stated. This content is protected by copyright, trademark, and other intellectual property laws.

This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Marjolein Empowers.

17. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.

Clients are encouraged to seek professional services where appropriate. Marjolein Empowers assumes no liability for any decisions or actions taken based on the coaching sessions.

To the fullest extent permitted by law, Marjolein Empowers and its affiliates, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of our services, including but not limited to loss of income, business interruption, or emotional distress. In any case, our total liability to you shall not exceed the amount paid by you for the services.

14. CHANGES

If Marjolein Empowers decides to change these general terms and conditions, we will post the changed terms and conditions on the Website. You are advised to regularly check whether they have changed. Existing contracts will not be affected by such changes.

15. GOVERNING LAW AND JURISDICTION

This general terms and conditions in relation to the use of the site is hereby governed by and constructed and enforced in accordance with the laws of Netherlands. The competent courts in Netherlands shall have the exclusive jurisdiction to resolve any dispute between you and Marjolein Empowers.
